GREENSBORO POWER STUDIOS PARTICIPANT AGREEMENT, RELEASE, ASSUMPTION OF RISK

In consideration of the services of Greensboro Power Studios (hereinafter “GPS”) and its agents, owners, officers, volunteers, students, participants, independent contractors, & all other persons or entities acting in any capacity by, through, under or on its behalf (hereinafter collectively referred to as the “indemnified parties”), I hereby agree to release, indemnify, and discharge the indemnified parties on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives and estate as follows:

• I acknowledge that my participation in yoga and strength classes, both inside the studio at 301 State Street and outside the studio at any community event, private lessons, workshops, teacher trainings, performance and training, individual and group initiatives, and personal growth and development exercises entails known and unanticipated risks that could result in physical and/or emotional injury and/or death. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: the hazards of slips and falls; being struck by objects dislodged or dropped from above; the hazards from using safety ropes and equipment; the risks of falling off equipment; the risks of landing improperly; the risks of being entangled; my own physical condition, and the physical exertion associated with any of these activities.
• I expressly agree and promise to accept and assume all of the risks arising out of these activities. My participation in any of the above activities is purely voluntary, and I elect to participate in spite of these risks. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the indemnified parties from and against any and all claims, demands, suits, judgments, damages, liability, cost or expense, or causes of action (including but not limited to claims of negligence), which are in any way connected with my participation in any activity with GPS or my use of any of GPS's equipment or facilities. I understand that GPS is not responsible for my personal property or any lost or stolen items.
• Should the indemnified parties or anyone acting on their behalf, be required to incur reasonable attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
• This Agreement is intended and shall be construed in accordance with the laws of the State of North Carolina without regard to the conflict of law rules of that State. I hereby consent to the exclusive jurisdiction of any state or federal court located in Guilford County, North Carolina. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.
• I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
• I certify to the best of my knowledge that I DO NOT have any of the following: Heart disease; glaucoma; high or low blood pressure; epilepsy; fainting spells; recent surgery; or severe injury.
• I acknowledge that I have had sufficient opportunity to read this entire document. I have read and understood it, and by purchasing this free ticket I agree to be bound by its terms. I agree that a digitally reproduced/scanned version of this waiver is fully valid and representative of the original, signed and executed copy.
