Contracts, like them or not, form the foundation of every construction project. Yet often, the terms that decide who carries the risk are the ones least understood.

From how a contract is actually formed, to who you're really contracting with, to the clauses that quietly shift millions in liability, small missteps at the front end have a habit of resurfacing as very expensive disputes at the back end.

Get on the front foot by joining Michael Batch, Tyler Atkins and Kate Ahnfeldt for a practical session that steps through the life cycle of a construction contract from contract formation right through to dealing with defects during the DLP. In this session, we’ll refer to case law and step though worked examples to illustrate:

• key risks associated with pre-contract dealings and contract formation. Here we’ll discuss common “interim” forms of contract like letters of intent;
• common terms within construction contracts and their meaning including indemnities, limits of liability and consequential loss;
• the basics of crafting key claims like provisional sum claims, extensions of time; and
• end of project issues and procedures including what to do during the DLP.
