UNSW Law Journal Issue 47(2) Launch

The University of New South Wales Law Journal is elated to announce the launch of Issue 47(2) on 25 July 2024, where Perry Herzfeld SC will deliver a keynote address on the thematic topic: ‘Developments in Rights, Freedoms and Accountability’. Perry Herzfeld is a Senior Counsel at Eleven Wentworth Chambers, a fellow of the Australian Academy of Law, the author of the leading text, Interpretation (Thomson Reuters, 2nd ed, 2020), and the incumbent Editor of the New South Wales Law Reports. Throughout his time as a barrister, Perry has been involved in a range of cases at the forefront of developments in rights, freedoms and accountability, including with respect to the indefinite detention of non-citizens and the suspension of judicial officers in Kiribati.

Issue 47(2)’s thematic component contains a total of six articles, each of which explore the implications and challenges arising from current developments in rights, freedoms and accountability within Australia at the domestic and international level. The articles within the Issue’s thematic component cover a diverse range of topics, including: the developments in human rights legislation at the state and Commonwealth levels; the evolution of anti-corruption commissions in Australia since their inception; the impact of tribunal guidelines and legal representation on vulnerable persons; the need for more robust accountability mechanisms in the provision of mental health care; and the tensions between the Brereton Report and Australia’s compliance with its international obligations in holding military commanders accountable for human rights violations during armed conflict.

Issue 47(2) also contains four general articles that broadly address developments in rights, freedoms and accountability within Australia, including: the progress of Indigenous treaty-making within Australia; the place for civil liability mechanisms to hold police and Pr*son officials accountable for harms suffered by Indigenous peoples in custody; the broader admission of expert testimony on intimate partner violence entrapment during criminal trials and sentencing; and whether the stricter regulation of buy now pay later would better protect low income consumers.

The launch event for Issue 47(2) will take place at 6pm on Thursday 25 July 2024 at the Sydney office of Corrs Chambers Westgarth.
