About this Event

Keating Chambers is pleased to host a full-day seminar dedicated to the Building Safety Act and its continuing impact on construction, property and professional liability disputes. The day's sessions will be Chaired by Simon Hargreaves KC and Jonathan Selby KC.

The programme will cover key areas including Remediation Contribution Orders, Building Liability Orders and other BSA remedies, with discussion of recent case law, practical challenges, resolving disputes and developing trends. Sessions will be chaired by senior members of Chambers and will include contributions from silks, juniors and guest speakers, offering attendees both legal analysis and practical insight.

The day will include a keynote address, morning and afternoon panel sessions, lunch and networking, and a final grand panel covering hot topics and audience Q&A. The day will close with drinks and canapes. Full programme details to follow in due course.

To help us manage attendance numbers and reduce last-minute drop-outs, we are charging a modest attendance fee for this event. This is not intended to generate a profit, and all proceeds will be donated to a charity supported by Chambers. Tickets are refundable (minus Eventbrite's administration fee) up to 7 days before the event. After this date, tickets are non-refundable, although substitutions may be made at no additional cost.

Panel 1: Remediation Contribution Orders

Info: Chaired by Clarissa Smith (Addleshaw Goddard), this session will explore key practical and legal issues arising from Remediation Contribution Orders (RCOs). Alice Sims will examine joint case management between the TCC and FTT, Jennie Wild will consider the question "What can you RCO?", and Alexandra Bodnar will address remedial works and the practicalities of RCOs. The session will conclude with a panel Q&A.

Info: This session will examine the evolving scope and application of Building Liability Orders (BLOs). James Frampton will consider Crest Nicholson v Ardmore and the "just and equitable" test, before Connie Trendle and Alexander Nissen KC explore anticipatory and adjudication BLOs respectively. Abdul Jinadu will consider the concept of the associated entity, including the implications of HB (WM) Ltd v STO Ltd, while Hugh Raven (Willmott Dixon) will provide a contractor's perspective throughout the discussion. The session will conclude with an audience Q&A.

Info: This panel will explore other remedies under the BSA, the practical effectiveness and reach of the Building Safety Act's information-gathering and enforcement mechanisms. Marie Claire O'Hara (Laing O'Rourke), Paul Bury, Harriet Di Francesco and Harry Smith will examine Information Orders, consider the utility of Regulation 3 Notices in light of SVPH v East Village Management Ltd, and discuss the challenges of serving proceedings and enforcing orders beyond the jurisdiction. The session will conclude with an audience Q&A.
