The "New Provincial Rights Movement"?: Anti-Constitutionalism in Canada

The term ‘anti-constitutional’ is frequently employed to signal actions that seem contrary to democratic constitutionalism or that appear to erode or violate broader constitutional norms. The term implies a distinction from something that is ‘unconstitutional’ in the sense of acting outside the boundaries of constitutional jurisdiction or infringing a discrete provision of the constitution in a legal sense. Yet there is surprisingly scant scholarly elaboration of the concept of ‘anti-constitutionalism.’ This talk will seek to articulate a substantive understanding of the concept via an exploration of recent provincial actions in Alberta, Saskatchewan, and Quebec relating to federalism and rights.
