This in-person event is a part of our public consultation, following publication of our first Consultation Paper for our project Business Tenancies: the right to renew.
Our first Consultation Paper asks key questions about possible options to reform Part 2 of the Landlord and Tenant Act 1954. The 1954 Act gives business tenants the legal right to another tenancy when their current tenancy comes to an end - a right known as "security of tenure".
In our consultation, we consider the pros and cons of the current "contracting-out" model of security of tenure and consider three alternative models: mandatory security of tenure, abolition of security of tenure, and a "contracting-in" model. We seek consultees' views on which model they prefer. We also seek views on whether or not the types of business tenancy which can benefit from security of tenure - the Act's scope - are the right ones.
Alongside the Consultation Paper, we are also conducting a short survey to help us understand the impact of the 1954 Act on the current commercial leasehold market. We encourage consultees to respond both to the Consultation Paper and to the survey.
During this consultation event, we will be discussing our first Consultation Paper and the key questions it asks about whether security of tenure needs to change.
This event will be held in person at the Ministry of Justice, 102 Petty France, London, SW1H 9AJ.
The event will be an opportunity to hear about our first Consultation Paper from Professor Nick Hopkins, the Commissioner for Property, Family and Trust Law, and his team.

The deadline for responses to be submitted to both the consultation and the survey is 19 February 2025.
