Death, Tenants and Due Process: Eviction Issues in Probate
About this Event
A death can create complicated questions about possession of real property, whether the deceased person was the landlord or the tenant. When a property owner dies, a personal representative may need to remove tenants, relatives, caregivers, former partners, or other occupants so the property can be secured, sold, or distributed. When a tenant dies, the landlord may be left with unpaid rent, a unit full of personal property, and family members requesting access—sometimes before anyone has been legally appointed to administer the tenant’s estate.
This CLE will examine the intersection of Nevada probate and landlord-tenant law in both situations. Topics will include determining who has legal authority to act, identifying the status and rights of occupants, selecting and serving appropriate notices, recovering possession, responding to family requests for access or belongings, handling a deceased tenant’s personal property, addressing unpaid rent, and avoiding common procedural and practical mistakes. The presenters will also discuss when probate counsel and landlord-tenant counsel should work together to resolve these matters efficiently while protecting the rights of the estate, landlord, occupants, and family members.
