ASSUMPTION OF RISK AND WAIVER OF LIABILITY

The Tunnel of Terror is an express carwash created to have a great time where we will scare and surprise you. Guests attend this establishment at their own risk.

Therefore, in allowing you to enter the property, you represent and promise that you voluntarily and expressly agree to release, discharge and hold Bellagio Express Car Wash, their owners, employees, affiliates, landlords, contractors, affiliated organizations, entities, any other persons assisting or participating in their activities, or other patrons harmless from any and all legal liability, property damage or medical liability, and personally assume all risks from any of their actions including, but not limited to, negligent acts or strict liability acts. This nature including but not limited to that for theft, injury, loss or damage of whatever nature, against the Proprietor, whether arising from the Proprietor’s default, negligence or otherwise. The guest, in addition to the aforesaid, hereby indemnify the Proprietor against any claims which may arise from whatever nature, whether arising from the Proprietor’s default, negligence or otherwise. This disclaimer is valid and automatically considered as accepted by guest entering the property.

Some of these risks are apparent: pregnant women, persons with heart or other debilitating conditions, asthma, and persons with emotional or physical trauma should not enter the haunted carwash. Other risks may not be apparent: All Vehicles MUST have their windows rolled up and doors locked or you may be incidentally touched by a performer or by a Tunnel of Terror effect. Finally, Tunnel of Terror contains special effects and frightening performers. Physical injury, death and/or property damage from them or from sudden reactions to them may occur.I will not enter if I suffer from asthma, heart condition, am prone to seizures, have physical ailments, have respiratory or any type of medical problem, am pregnant or suffer any form of mental disease including claustrophobia.I voluntarily assume all risks and dangers associated with participation in this attraction. In consideration and acceptance of entrance onto the property I agree to release Bellagio Express Car Wash, its parent corporations, affiliates, officers, directors, employees and landlord from any liability for any harm, injury or death, cost or expense whatsoever that may arise.

COVID-19

I agree, understand, and acknowledge that an inherent risk of exposure to the disease COVID-19 (as defined by the World Health Organization and any strains, variants, or mutations thereof) and SARS-CoV-2 (the virus that can cause COVID-19) (collectively, “COVID-19”), and any other communicable or infectious disease, exists in any public place where people are present. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. Please note the CDC advises that older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Guests should evaluate their risk in determining whether to attend. People who show no symptoms can spread COVID-19 if they are infected, any interaction with the general public poses an elevated risk of being exposed to COVID-19, and we cannot guarantee that you will not be exposed during your visit. This waiver of liability and the assumption of risk set forth above is intended to be as broad and inclusive as is permitted by law.

I attest, acknowledge, and agree that any individual for whom I have bought an admission ticket for has independently and carefully read this Assumption of Risk and Waiver of Liability and has knowingly and independently acknowledged and agreed to all its provisions.

Bellagio Express Car Wash is not responsible for loss or damage to personal property.

Cameras and Video Recording

Cameras and Video recording devices are located throughout car wash. By entering the premises you are waiving any right to financial compensation and consent to have your photograph/video footage released and displayed for sole use of Tunnel of Terror. The captured images/video may be used to promote the car wash in print, various forms of media, and websites. You consent that the footage remains our property and we may use it in conjunction with promotion of our events however we choose, in perpetuity.

If any provision or part thereof of these terms and conditions is held to be invalid, void, or unenforceable by a court of competent jurisdiction, such provision or part thereof shall be deemed modified to conform to applicable law, or if this would cause an illogical or unreasonable result, such provision or part thereof shall be stricken from the terms and conditions without affecting the binding force or effect of any other part or provision.

NO REFUNDS. NO EXCHANGES. ALL SALES ARE FINAL.

In case of cancellation due to natural catastrophe or any other event beyond the control of the Attraction the event will be rescheduled.Ticket holders or attendees of the event consent to being filmed, photographed, and recorded as members of the audience. The resulting film footage, images and recordings may be used to promote Tunnel of Terror in print, various forms of media, and on websites. You consent that the footage remains our property and we may use it in conjunction with promotion of our event however we choose.Event goers must comply with all relevant statutes, laws, safety announcements, and regulations while attending the event. Breach of any of these conditions or any unacceptable behavior likely to cause damage, nuisance or injury shall enable Bellagio Express Car Wash its security personnel, volunteers, staff, or event organizers to eject the attendee(s) from the event site without a refund.
