A fun night out and a chance to take some pressure off next month.

🛡️ Waiver, Assumption of Risk, Release of Liability, Media Permission and Event Terms

IMPORTANT — PLEASE READ BEFORE PURCHASING, REGISTERING OR PARTICIPATING.

These terms contain an assumption of risk, a release of liability that includes negligence where legally permitted, limitations of liability and an indemnity. They may affect your legal rights.

The Silent Party Company is referred to below as the “Organizer.” Each person attending or participating is referred to as an “attendee.”

Questions about these terms, accessibility, participation or ticket arrangements may be directed to [email protected].

📋 1. Scope and Application

These terms apply to events, activities, gatherings, classes, experiences, activations and related programming operated, organized, hosted, supported or promoted by the Organizer, whether ticketed or unticketed, indoors or outdoors, directly delivered or delivered with partners.

Activities may include, without limitation:

• Stretching, mobility, yoga, Pilates, fitness classes, warm-ups and cooldowns.
• Running, jogging, walking, Run Raves and other route-based activities.
• Dance, silent discos, live music, DJs and headphone-based experiences.
• Meditation, breathwork, sound experiences and other wellness activities.
• Recovery activities, sauna, cold plunge and other heat- or cold-based experiences.
• Outdoor, waterfront, beach, park, rooftop, studio, venue and community activities.
• Social gatherings, markets, vendor activities, food and beverage experiences, and partner programming.
• Use of headphones, exercise props, audio equipment, lighting and other supplied equipment.

An activity is included with a particular ticket only where expressly stated in that event’s description or ticket conditions.

These general terms may be used across present and future events. For each event, the applicable terms are those disclosed and accepted for that event, together with its event-specific conditions. Attending one event does not automatically constitute acceptance of undisclosed changes for future events.

✅ 2. Notice, Purchase and Individual Acceptance

These terms are made available before purchase or registration.

By purchasing or registering, the purchaser acknowledges having had an opportunity to review them and agrees to the provisions that lawfully apply to the purchaser.

An attendee who receives reasonable notice of these terms and subsequently accepts or uses a ticket, attends or voluntarily participates acknowledges the applicable terms and agrees to them to the extent permitted by law.

The Organizer may require a separate written or electronic acknowledgment, participation form, venue waiver or other documentation before an activity begins. Publication of these terms does not replace any consent or acceptance process required by applicable law.

🎟️ 3. Tickets Purchased or Transferred for Other People

Anyone purchasing, reserving or transferring a ticket for another person must provide that person with access to these terms and the applicable event conditions before completing the purchase or transfer and allow a meaningful opportunity to review them.

This responsibility includes sharing relevant information about:

• Activities, physical demands and participation risks.
• Ticket inclusions, age restrictions and venue requirements.
• Refund, postponement and transfer conditions.
• Required waivers, acknowledgments and event-specific rules.

Each adult attendee is responsible for their own acceptance. Purchasing, holding or transferring another adult’s ticket does not, by itself, authorize the purchaser to waive that person’s legal rights.

Purchasers must not falsely represent that another person has reviewed or accepted terms. Where individual acceptance is required, the attending person must complete it themselves.

⚠️ 4. Voluntary Participation and Assumption of Risk

Attendance and participation are voluntary. No attendee is required to take part in every activity, perform a particular movement, maintain a particular intensity or enter a sauna, cold plunge or body of water.

Activities may involve inherent risks and additional risks arising from the environment, equipment, premises, other participants or third parties. Some risks may be foreseeable; others may not be apparent in advance.

Risks may include:

• Physical injury, illness, fatigue, dehydration, dizziness, fainting and aggravation of existing conditions.
• Falls, collisions, strains, sprains, fractures, head injuries and other accidents.
• Heat or cold exposure, breathing difficulties, allergic reactions and other adverse physical responses.
• Emotional discomfort or distress.
• Permanent disability or death.
• Loss of, theft of or damage to personal property.

By voluntarily participating after receiving notice of the relevant risks, an attendee accepts the risks associated with their chosen participation, subject to applicable law and the release provisions below.

This assumption of risk does not remove duties or rights that cannot lawfully be excluded.

🩺 5. Health, Fitness and Medical Responsibility

Attendees are responsible for considering whether they are physically and medically able to participate safely in their chosen activities.

Attendees should seek appropriate advice from a qualified healthcare professional where their health, Medic*tion, pregnancy, injury, symptoms or other circumstances may affect participation.

Attendees must monitor their condition, choose an appropriate level of participation, and modify, pause or stop when necessary. They should promptly notify an instructor or event representative if they become unwell or need assistance.

Unless expressly identified as a healthcare service delivered by an appropriately qualified provider under separate arrangements, event programming is not medical care, diagnosis, treatment, rehabilitation, psychotherapy or individualized medical advice.

No particular health, fitness, recovery or psychological outcome is guaranteed.

🧘 6. Exercise, Movement and Wellness Activities

Stretching, mobility, yoga, Pilates, running, dance, fitness, breathwork and other wellness activities may involve exertion, balance, coordination, repetitive movement, guided positions or unfamiliar techniques.

Risks may include muscle or joint strain, loss of balance, discomfort, soreness, dizziness, fatigue, breathing discomfort and aggravation of existing conditions.

Attendees must work within their own abilities, use modifications where appropriate and avoid continuing a movement or practice that feels unsafe. General instruction does not replace an individual assessment of suitability.

🎧 7. Headphones, Music, Lighting and Equipment

Events may involve headphones, audio systems, DJs, amplified sound, lighting effects, low-light environments, cables, transmitters, batteries, chargers, generators and other equipment.

Associated risks may include:

• Reduced awareness of surrounding people, vehicles, instructions or hazards.
• Sound-related discomfort or hearing injury.
• Trips, falls, collisions and crowd movement.
• Equipment malfunction, overheating, electrical hazards, shock or fire.
• Discomfort or adverse reactions to lighting effects or loud sound.

Attendees must use equipment only as intended, follow instructions, maintain appropriate volume and remain aware of their surroundings. Equipment must not be altered, submerged, disconnected or interfered with unless authorized.

Attendees should ask for assistance with fit, operation or adjustments before participating.

🏃 8. Running, Routes and Public Spaces

Route-based activities may take place on shared paths, sidewalks, trails, roads, crossings, boardwalks, parks or other public or private spaces.

Risks include uneven or slippery surfaces, curbs, stairs, sand, debris, poor visibility, changing weather, traffic, cyclists, pedestrians, animals and separation from the group.

Unless expressly stated otherwise, a route is not closed to the public or traffic. Attendees must obey applicable laws, signs and crossing requirements and follow reasonable route and safety instructions.

Published pace information describes the planned activity. Attendees should assess whether it suits their abilities, maintain a safe pace and notify the crew if they need to stop or become separated.

♨️ 9. Sauna, Cold Plunge, Water and Recovery Activities

Sauna, cold plunge, heat exposure, cold exposure and other recovery activities are optional and may require separate admission, provider consent or a venue waiver.

Risks may include overheating, dehydration, dizziness, fainting, sudden temperature changes, breathing difficulties, adverse cardiovascular responses, slippery surfaces, falls and water-related injury or drowning.

Attendees must follow provider instructions, posted limits and their own medical advice. They must not remain in an activity when feeling unwell or participate while impaired.

Outdoor swimming, wading or water entry is included in an event only where expressly identified. Proximity to a beach or waterfront does not mean swimming is organized, supervised or permitted.

Where outdoor water activity is offered, additional risks may include currents, waves, depth changes, poor water quality, submerged objects, unstable footing and limited rescue access. Lifeguard or rescue supervision must not be assumed unless expressly confirmed.

🌦️ 10. Weather and Environmental Conditions

Outdoor events may be affected by heat, cold, wind, rain, snow, ice, humidity, poor air quality, smoke, lightning, storms, darkness and changing ground conditions.

Attendees should dress appropriately, bring suitable supplies and follow instructions relating to weather or environmental hazards.

The Organizer may modify, delay, relocate, suspend, postpone or cancel an activity when reasonably necessary. Changes and any associated refund rights are governed by Sections 21 and 22.

🥤11. Food, Beverages and Other Consumables

Venues, vendors, sponsors or other providers may offer food, beverages, samples, supplements or other consumables.

Consumption is voluntary. Attendees are responsible for asking about ingredients, communicating relevant allergies or restrictions, and deciding whether an item is suitable for them.

The Organizer does not guarantee that third-party products are free from allergens, contamination or other risks unless expressly represented otherwise. Providers remain responsible for their own products and obligations.

Nothing in this section excludes responsibility that applicable law does not permit the Organizer or a provider to exclude.

🐾 12. Animals and Pets

Animals may be present at outdoor locations, public spaces or events where permitted. Risks may include allergies, bites, scratches, collisions and unpredictable behaviour.

Owners and handlers must comply with venue rules and applicable law and maintain appropriate control of their animals. Attendees supervising children must exercise appropriate care around animals.

Service-animal access and accommodation will be addressed in accordance with applicable law.

🤝 13. Independent Providers, Venues and Event Partners

Events may involve independent instructors, studios, venues, recovery providers, running clubs, community organizations, vendors, sponsors, collaborators, transport providers and other service providers.

Each provider is responsible for its own services, personnel, products and applicable professional or legal obligations. Separate provider terms may apply where disclosed.

The Organizer’s involvement in promoting, supporting or coordinating an activity does not mean it directly operates every service or controls every provider.

This allocation of responsibilities does not exclude any duty or liability the Organizer or another party retains under applicable law.

🛠️ 14. Supplied Equipment and Property Damage

Headphones, accessories, exercise props, furniture, fixtures and other supplied property are provided for temporary use unless expressly stated otherwise.

Attendees must:

• Use property carefully and only for its intended purpose.
• Follow instructions and report faults or damage promptly.
• Return borrowed equipment at the instructed time and location.
• Avoid unauthorized removal, modification or transfer to another person.

An attendee may be responsible for reasonable repair or replacement costs to the extent loss or damage is caused by their negligence, misuse, intentional conduct or breach of these terms.

Any applicable fixed replacement fee or deposit condition must be disclosed before acceptance. An attendee is not automatically responsible for pre-existing damage or ordinary wear.

🎒 15. Personal Belongings

Attendees are responsible for keeping track of their belongings, including phones, bags, clothing, keys, valuables and vehicles.

Storage, bag transport, lockers or security are included only where expressly confirmed. Attendees should not assume that items left unattended are being supervised.

The Organizer does not guarantee against loss, theft or damage. Any limitation of responsibility remains subject to applicable law and the release provisions below.

🛑 16. Conduct, Instructions and Removal

Attendees must behave respectfully and follow reasonable instructions from organizers, instructors, venue staff, safety personnel and relevant event partners.

Participation may be restricted or refused, or an attendee removed, where reasonably necessary because of:

• Unsafe conduct or impairment.
• Violence, threats, harassment or disruptive behaviour.
• Failure to follow reasonable safety instructions or event rules.
• Property damage or interference with equipment or staff.
• Fraudulent, invalid or improperly transferred admission.
• Conduct creating a material risk to the attendee or others.

Decisions will remain subject to applicable accommodation and human rights requirements.

Removal for the attendee’s own misconduct does not automatically create a refund entitlement, subject to applicable law and mandatory ticketing-platform policies.

🍷 17. Alcohol, Substances and Fitness to Participate

Attendees are responsible for their decisions concerning alcohol, cannabis, Medic*tion, supplements and other substances before, during and after an event.

Attendees must comply with venue rules and applicable laws and must not participate in activities when impaired or otherwise unsafe.

The availability of alcohol or another product at an event does not represent that it is suitable to combine with exercise, sauna, cold plunge or other activities.

Attendees are responsible for arranging safe transportation and must not drive while impaired.

🚗 18. Transportation and Travel

Unless expressly included, attendees are responsible for travel to and from the event, parking and their own transportation arrangements.

Attendees should check start and finish locations, particularly for point-to-point activities, and allow sufficient travel time.

Recommendations or information about transit, parking or independent transport providers do not constitute a guarantee of availability or service.

Where transportation is expressly arranged or supplied as part of an event, the disclosed transport conditions and applicable legal duties continue to apply.

🚑 19. Emergency Assistance

Attendees should promptly notify staff if they experience an injury, illness or other emergency.

The Organizer or its representatives may contact emergency services, provide assistance within their training, or arrange appropriate support. Qualified medical personnel or dedicated emergency transport should not be assumed to be on-site unless expressly advertised.

Responsibility for ambulance, medical or related charges will be determined by applicable law and insurance arrangements. These terms do not transfer costs that another party is legally responsible for paying.

Nothing in this section excludes any duty to respond to an emergency that applicable law imposes.

👨‍👩‍👧 20. Minors and Age Restrictions

Attendees must meet the age requirements published for the event, venue and applicable activities.

Minors may attend only where expressly permitted. A parent or legal guardian must review the event conditions, provide required participation and emergency consent, and arrange the supervision specified for the event.

A person who is not a parent or legal guardian must not represent that they can provide consent reserved for a parent or guardian.

Any consent or release on a minor’s behalf operates only to the extent legally permitted. These terms do not assert that a parent or guardian can waive every legal claim belonging to a child.

Reasonable age verification may be required where appropriate.

📅 21. Changes, Relocation, Postponement and Rescheduling

The Organizer may reasonably change the schedule, programming, instructors, DJs, partners, route, venue, location, format, activities or date because of weather, safety concerns, venue availability, government restrictions, operational circumstances, force majeure or other circumstances affecting delivery.

Material changes will be communicated promptly through the booking contact details or another appropriate channel.

For a genuine postponement or rescheduling, tickets generally remain valid for the rescheduled event at the purchased admission level. Rescheduling does not, by itself, guarantee a discretionary refund.

Reasonable changes do not authorize the Organizer to remove the main advertised experience without providing any remedy required by law or the ticketing platform.

A replacement event, credit or alternative experience may be offered where appropriate. Offering such an option does not automatically extinguish an existing refund entitlement.

↩️ 22. Final Sale, Refunds and Credits

Tickets are generally final sale and non-refundable, subject to applicable law and mandatory ticketing-platform requirements.

The following do not, by themselves, create a refund entitlement:

• Choosing not to attend or being personally unable to attend.
• Arriving late, leaving early or missing programming.
• Travel, parking, work, childcare or other personal scheduling difficulties.
• Weather concerns where the event proceeds and the advertised experience is delivered.
• Reasonable schedule, instructor, partner, route or venue adjustments that preserve the main advertised experience.
• Genuine postponement or rescheduling, subject to the mandatory exceptions below.

Required refunds take priority over this general final-sale policy.

If an event is cancelled, not performed, or fails to provide the main advertised experience, refunds or other remedies will be provided where required by applicable law or the ticketing platform.

For Eventbrite purchases:

• Genuine postponements will be handled under Eventbrite’s Postponed Event Policy.
• A new date will be set and communicated within 90 days of postponement; where that cannot be done, cancellation and refunds will be handled under Eventbrite’s requirements.
• All applicable mandatory refund periods and requirements will be honoured, including any entitlement that continues after a later rescheduling.
• Refund conditions applicable at purchase will not subsequently be made less favourable.

Where a refund is not required, the Organizer may offer a credit, transfer or other accommodation. A credit will not be imposed in place of a refund that must be provided.

Submit requests through the applicable ticketing platform or email [email protected] with the order number. A first response will be provided within five business days.

Travel, accommodation and incidental costs are not ordinarily reimbursed, except where required by law or expressly agreed.

📸 23. Photography, Video, Audio and Media Permission

Photography, filming, livestreaming and audio recording may take place before, during and after events. Attendees should reasonably expect that they may appear incidentally or directly in event photographs, videos, social media content and recap footage.

Where valid consent has been provided, the attendee authorizes the Organizer and its authorized photographers, production providers and event partners to capture, edit, reproduce and publish the attendee’s image, likeness and voice for the disclosed purposes of documenting events and promoting the Organizer and the relevant event or partnership.

These uses may include websites, social media, promotional materials and advertisements, without compensation unless separately agreed. Authorized partners may use material only within the purposes and permission communicated to the attendee.

Attendance after clear notice may constitute consent only where permitted by law and appropriate to the circumstances. Separate express consent will be obtained where required, including for sensitive or unexpected uses and where required for minors. Optional promotional consent is not a condition of participation.

Attendees may communicate photography preferences or request withdrawal of consent by speaking with the event team or contacting [email protected]. The Organizer will explain available arrangements and take reasonable steps to respect valid preferences and withdrawals.

Withdrawal is subject to applicable law, reasonable notice and lawful restrictions. The Organizer cannot guarantee removal of copies independently shared by others, but will address material within its control as required by law.

Filming is not permitted in changing rooms or other spaces where privacy is reasonably expected. Nothing in this permission authorizes misleading endorsements or removes privacy rights that cannot lawfully be waived.

♿ 24. Accessibility and Accommodation

Attendees seeking accessibility information or accommodation should contact [email protected] as early as practicable.

The Organizer will work with the attendee and relevant venues or providers to assess individual needs and explore appropriate accommodation in accordance with applicable human rights law, up to the point of undue hardship.

Advance notice assists planning; a late request does not automatically remove an attendee’s entitlement to accommodation.

🛡️ 25. Release of Liability

For this section and Sections 26 and 27, “Released Parties” means the Organizer and its owners, officers, directors, employees, contractors, instructors, volunteers, DJs, hosts, venue operators, studios, sponsors, vendors, collaborators, affiliates, service providers and event partners, in connection with their involvement in the applicable event.

In consideration of being permitted to attend or participate, each adult attendee who has accepted this release, to the fullest extent permitted by applicable law, releases and agrees not to bring claims against the Released Parties arising from that attendee’s attendance, participation, use of event premises or equipment, or involvement in event activities.

This includes claims for personal injury, illness, accidents, death, and property loss or damage, including claims caused by a Released Party’s negligence where that liability may lawfully be released.

THIS RELEASE INCLUDES NEGLIGENCE, including negligent instruction, supervision, organization, maintenance or failure to warn, to the extent such liability may legally be released.

This release does not exclude fraud, intentional misconduct, or any liability, duty or right that applicable law does not permit to be excluded.

The protections are intended to benefit each Released Party in connection with its involvement in the applicable event and may be relied on by that party to the extent permitted by law.

⚖️ 26. Limitations and Mandatory Rights

To the extent permitted by law, the Released Parties are not responsible for indirect or consequential losses arising from attendance or event changes, including lost income, missed opportunities or independently incurred travel expenses.

No particular personal experience, fitness improvement, recovery outcome or uninterrupted availability of every incidental feature is guaranteed.

These limitations do not override:

• Mandatory consumer protections or required refunds.
• Obligations concerning the main advertised goods or services.
• Applicable privacy, accessibility or human rights requirements.
• Liability that cannot lawfully be excluded or limited.
• A separate express commitment that the Organizer or provider is legally required to honour.

📑 27. Indemnification

To the extent permitted by law, an attendee agrees to indemnify and hold harmless the Released Parties against reasonable losses, third-party claims, damages and legal costs to the extent caused by that attendee’s negligence, intentional misconduct or breach of these terms.

This may include damage the attendee causes to property or injury the attendee causes to another person.

The indemnity does not make an attendee responsible for:

• A Released Party’s own negligence, fraud or intentional misconduct.
• Another adult’s conduct merely because the attendee purchased or transferred that person’s ticket.
• Liability that applicable law does not permit to be transferred.
• Claims or rights belonging to a minor that cannot lawfully be waived or restricted.

🎁 28. Event-Specific Conditions, Promotions and Updates

These terms operate together with the event description, disclosed ticket conditions, applicable venue requirements and any separate activity-specific documents.

Additional restrictions, material conditions or waivers must be brought to the affected attendee’s attention and accepted where required.

Any contest, giveaway or prize promotion is governed by its separate Official Contest Rules. General powers to change an event or ticket arrangement do not, by themselves, permit an announced prize or established entry rights to be changed or withdrawn.

Updates to these general terms apply prospectively when appropriately disclosed and accepted. They do not retroactively alter an earlier ticket contract or accrued rights.

Nothing in these terms removes legal remedies for misleading statements or permits undisclosed conditions to override the main advertised experience.

⚖️ 29. Severability and Applicable Law

If a provision is found invalid or unenforceable, it will be limited or severed to the extent legally appropriate. The remaining provisions will continue to apply where they can operate lawfully.

These terms are governed by Ontario law and the applicable federal laws of Canada, except where mandatory law requires otherwise.

Disputes remain subject to courts or tribunals having lawful jurisdiction. Nothing in these terms removes a mandatory right to bring a claim in another permitted jurisdiction or forum.

✍️ 30. Final Acknowledgment

By purchasing or registering, the purchaser acknowledges having had an opportunity to review these terms and accepts the provisions lawfully applicable to them.

Each attendee who accepts these terms confirms that they:

• Have had an opportunity to review the event conditions and ask questions.
• Understand that participation involves risks and is voluntary.
• Are responsible for selecting an appropriate level of participation and following reasonable instructions.
• Understand that the liability release includes negligence where legally permitted.
• Accept the applicable terms for themselves, without falsely representing acceptance on behalf of another adult.
• Understand that mandatory legal rights remain protected.

Use of a ticket or participation after reasonable notice may constitute acknowledgment and acceptance only to the extent permitted by law. Any required individual written or electronic acceptance, guardian consent or separate media permission remains necessary.
