The Employment Laws You Need to Know module consists of two parts.

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping, and minor labor law requirements affecting employees in both the private sector and in Federal, State, and local governments. Key components of this nuanced law include regulations on how to properly classify employees as exempt or nonexempt, and instruction as to when time is compensable, such as time an employee spends traveling or in training. Join an ERC HR Advisor for a 90-minute crash course on how to navigate this federal law, and what you need to know to ensure compliance and avoid fines.

General course topics include:

• What is covered and what is not under the FLSA
• Classifying a worker as an Independent Contractor vs. Employee
• How to calculate an employee’s regular rate of pay and overtime
• What is considered compensable time
• Properly classifying employees as exempt or non-exempt
• Making permissible deductions from an employee’s pay
• Recordkeeping requirements

Navigating the Family Medical Leave Act (FMLA) can be confusing, especially if an employee needs intermittent leave. The first half of this segment provides instruction on when and how to provide 12 weeks of job protected leave to eligible employees. The second segment introduces you to the requirements under the Americans with Disabilities Act (ADA). Learners will get an overview of the interactive process, the legal obligations regarding reasonable accommodation, and when accommodation requests have caused an undue burden.
