This high-level policy workshop will explore the impact of EU law and policies on the present and future of music creators' rights. Researchers from the Horizon Europe-funded Fair MusE project will showcase findings from their ongoing in-depth investigations focusing on streaming services and social media platforms. This workshop aims to facilitate a dialogue among policy, legal, and industry experts on the complexities and challenges surrounding the implementation of EU laws targeting algorithmic and data-driven music exploitation. The event consists of 3 panels, each including a presentation by Fair MusE researchers followed by a debate led by invited experts and open to the public.
This high-level workshop is aimed at professionals, scholars, and enthusiasts with a vested interest or background in the music industry, particularly in legal or practical elements. We especially welcome those with expertise in industry practices or regulatory frameworks at the EU or Portuguese levels, as we aim to encourage a beneficial exchange of experience and ideas.
Panel 1
"What does ‘fairness’ mean in EU Law and Policy and in Copyright Law?"
Questions that will be discussed include: What is the meaning of fairness in EU law? Does EU law achieve a fair balance of interests for music creators? How effective are the rights of creators under the 2019 EU Digital Single Market Directive?

Panel 2
"Social Media Copyright Liability and Regulation of Collective Rights Management under EU Law: Their Effects on the European Music Industry."
Questions that will be discussed include: What impact does Article 17 of the 2019 EU Digital Single Market Directive have on music licensing for social media platforms? How do national implementations of EU Directive 2014/26 affect remuneration? Are current EU copyright rules improving the music licensing market?

"Competition Law and Platform Regulation as Instruments to Enhance Fairness in the Digital Music Sector."
Questions that will be discussed include: How do competition law and platform regulation affect music creators? What challenges do smaller creators face under current EU regulations? How can data transparency enhance fairness in the digital music market?
