This seminar will consider which material Scots lawyers have addressed under the heading “The Law of Persons” as well as the critique of the category made by Stair in his Institutions. A defence will be offered for the category’s utility and a scheme will be proposed which lays out and explains which rules of private law are most helpfully considered to be part of it. The category’s relationships with the rest of private law will be addressed, with particular attention to the relations with delict, family law and trusts.
Speaker biography
John MacLeod joined the Law School in 2018 from the University of Glasgow. His interests range across private and commercial law, with a particular focus on structural and taxonomical questions, the law of delict, the law of property and the law of debt. He has worked extensively with the Scottish Law Commission and the Law Reform Committee of the Law Society of Scotland. He delivers CPD across a range of topics.
