"Judges are like umpires. Umpires don’t make the rules, they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules, but it is a limited role. Nobody ever went to a ball game to see the umpire."
In the opening statement to his confirmation hearing, John Roberts famously likened his role as a judge and future Chief Justice of the Supreme Court to that of an umpire, whose job is to call balls and strikes, nothing more.
Twenty years later, we have a plethora of decisions that call this narrow characterization into question — Citizens United, Shelby County, Dobbs, Loper-Bright, and Skrmetti, to name a few. Then, the rise of unitary executive sympathies, selective originalism, and a notable increase in use of the shadow docket. Is this Supreme Court truly an umpire calling balls and strikes, as John Roberts called it, or is it a pinch hitter, creating strategic advantage for achieving preferred policy goals?
