Identify overarching Provincial OH&S legislative responsibility for construction projects and related guidance material
Identify key considerations in determining who is an owner, constructor, employer and contractor
Understand the difference between engaging a contractor to undertake construction vs. maintenance work
Recognize the benefits and process of obtaining a Ministry of Labour Director’s Designation
Explore relevant OHSA prosecutions and coroner’s inquest recommendations including:
-> the final decision in the R. vs Sudbury case where the City of Sudbury was charged both as the Constructor and an Employer despite having hired a constructor to undertake the project, and
-> a fatal construction accident that occurred at a Federal Government building.
