Both Tool and Target: AI in Legal Hold and eDiscovery
While AI has impacted information governance in many ways, the issues raised by the intersection of AI, legal hold, and eDiscovery are critical for RIM and IG pros to understand. On the one hand, AI tools are extending and improving automated review capabilities for large datasets to scope, enforce, and process legal holds. These allow practitioners to focus less on the mechanics of discovering and evaluating responsive data and turn instead to applying IG expertise to the work of the eDiscovery team working the matter. However, the use of AI tools across the enterprise also generates extremely large sets of new (and new types of) data that are themselves potentially discoverable as part of future litigation. The methods and tools to access this new data are emerging and in some cases not ready for prime time, increasing eDiscovery risk and cost. In addition, RIM and IG pros need to evolve their retention and disposal schedules to reflect the legal, regulatory, and operational requirements for managing this novel data.
