• First team of 2 or 3 Riders out at 9 am (last team out at Noon). • First Flight or Hilltopper Divisions • $80 per adult Rider ($60 for Jrs). Must pre-register and prepay by October 16. Riders may select their own ride times. Teams go out every three minutes.• Breakfast/Lunch for purchase from Cider Bro’s Truck, plus some Treats from Nancy. • 6-9 mile Course, all jumps with go-arounds • Ribbons for each Division. • Sadly, no dogs, please. • Casual attire. (1) Breakfast and/or Lunch will be available for purchase from the Cider Bro’s Truck onsite. Nancy will be bringing some of her famous treats, and some caffeine and water, as well as carrots, will be available near the Start/Finish area.

(2) Registration online or mail entries in advance of October 6th deadline.

(3) Responsible Hunter Pacing. Please ride with courtesy and common sense toward other riders. When overtaking, please call out courteously, and then pass without creating a ruckus. Above all, please greet and enjoy your fellow riders, and be prepared to assist them if needed.

I understand that this is a HIGH -RISK sport, and I am participating at my own risk. I assume complete responsibility for any injury, illness, accident, or loss incurred while a participant in the Millbrook Pony Club Hunter Pace. Neither I nor my representative, assignees, or heirs shall make any claim against, maintain an action against or recover from the Millbrook Pony Club or its officers or other volunteers, or Wethersfield or its officers, employees or volunteers, or any property owners over whose land the course is laid or any other organization or persons associated with the event, for injury, illness, loss, damage or death to myself or my property, resulting from participation (including COVID 19). THE UNITED STATES PONY CLUBS, INC. RELEASE, ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT FOR USPC NON-MEMBERS This document waives important legal rights. Read it carefully before signing.

I AGREE for myself, and/or my child, my/our administrators and assigns, in consideration for my, and/or my child’s, participation in this United States Pony Clubs, Inc. (USPC) activity to the following:

I AGREE that I choose to participate voluntarily in a USPC activity, as a rider, driver, handler, lessee, owner, agent, spectator, volunteer, and/or trainer. I am fully aware and acknowledge that horse sports and USPC activities involve inherent dangerous risks of accident, loss, and serious bodily injury including, but not limited to, broken bones, head injuries, trauma, pain, suffering, or death (“Harm”). I fully understand that this release covers, but is not limited to, inherent risks of an equine activity which mean a danger or condition that is an integral part of an equine activity, including but not limited to, any of the following:

• The propensity of an equine to behave in ways that may result in injury, death, or loss to persons on or around the equine; • The unpredictability of an equine’s reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals; • Hazards, including, but not limited to, surface or subsurface conditions;

• A collision with another equine, another animal, a person, or an object;

• The potential of an equine activity instructor to act in a negligent manner that may contribute to injury, death, or loss to the person or the participant or to other persons, including but not limited to, failing to maintain control over an equine or failing to act within the ability of the participant.

I AGREE to release the USPC, its successors or assigns, officials, officers, directors, employees, agents, personnel, volunteers and affiliated organizations from all claims including, but not limited to, claims for money or property, disability, covenants, actions, suits, causes or action, obligations, debts, costs, expenses, attorneys’ fees, judgments, orders and liabilities of whatsoever kind or nature in law, equity or otherwise, whether now known or unknown, suspected or

unsuspected, and whether concealed or hidden, including but not limited to any state or federal statutory or common law claim or remedy of any kind whatsoever arising out of or in any way connected with any Harm to me or my horse and for any Harm caused by me or my horse to others, even if the Harm resulted, directly or indirectly, from the negligence of the USPC or the USPC activity.

I AGREE to expressly assume all risks of Harm to me or my horse, including Harm resulting from the negligence of the USPC or the USPC activity and specifically agree to the applicable state statute/law regarding equine/farm animal activity liability and signed posting (if any), in any state in which I or my child participates in a USPC activity. A list of state statutes and select portions of those statutes believed to be in effect at the time of the execution of this agreement is attached hereto. I AGREE to review and understand the full applicable state statutes.

I AGREE to indemnify (that is, to pay any losses, damages, or costs incurred by) the USPC and the USPC activity and to hold them harmless with respect to claims for Harm to me or my horse, and for claims made by others for any Harm caused by me or my horse in the USPC activity.

I AGREE that neither I, nor anyone claiming through me, will hereafter bring, commence, prosecute or maintain, or cause or permit to be brought, commenced, prosecuted or maintained, any suit or action, either at law or in equity, in any court in the United States or in any state thereof, or elsewhere, against the USPC, its successors or assigns, for, on account of, arising out of, or in any way connected with any Harm to me or my horse, and that neither I, nor any one claiming through me, will enforce, prosecute, or recover upon, or attempt to enforce, prosecute, or recover upon, any claim or right of action whatsoever, which I, or anyone claiming through me, may now have or hereafter assert, in any way connected with claims for Harm to me or my horse, and for claims made by others for any Harms caused by me or my horse at the USPC activity.

I AGREE this Agreement is the entire agreement of the parties, and supersedes all prior oral and written understandings and agreements. This Agreement may be modified only by a written amendment signed by both parties.

I AGREE that if any provision of the Agreement is found to be invalid or illegal by a court of competent jurisdiction, the remaining provisions shall be construed as if the affected provision had not been included in order to effectuate the intent of the parties.

In the event this form is signed by the parent/guardian of a child, then all representations and acknowledgments herein are expressly made by, for, and on behalf of the parent/guardian and child.

By signing below, I AGREE to be bound by all applicable USPC rules and all terms and provisions of the USPC activity. I acknowledge that I enter into this release after having read the same and place my signature hereto of my own free voluntary act and deed. By signing below, I represent to the USPC that I fully understand its contents, that I do not need any further explanation, and I that waive any further explanation.

Release, Waiver of Liability and Indemnification Agreement

I have asked, been asked, or wish to engage in one or more of the following activities: A. Equestrian, horseback riding, taking lessons, attending clinics, jumping, trail riding, fox hunting, exercising, showing, racing, and preparing horses for equestrian activities, or other sporting and related activities, including without limitation, beagling and hiking; B. Boarding, training, exercising, pasturing, caring for, preparing horses for equestrian activities, loading and unloading horses, use of carriages, or any other use of, or relationship to, horses or other animals; C. ATV us or any other type or use of motorized and/or mechanical equipment; or D. Any other recreational, sporting, or physical activity in which I may exert myself in any degree. All the preceding are defined as the “Activities”.

Some or all of the Activities may take place on the real property of Wethersfield Foundation, Inc., f/k/a Homeland Foundation, Inc. This owner, and its affiliated entities, officers, directors, shareholders, managers, agents, and/ or employees are hereinafter collectively defined as the “Released Parties”.

I understand and agree that, unless I had read, understood, signed, and delivered this agreement, I would not have been asked, asked, or agreed to engage in any of the Activities with any of the Released Parties or on their property.

I wish to participate in the Activities, or enter the Released Parties’ property, although I know of the dangers associated with the Activities, and understand and know that they can lead to personal injuries or death, and property damage.

I fully understand that the Activities I may engage in with the Released Parties, or upon their real property, whether or not the Released Parties are with me or not, are very dangerous, and can lead to serious physical injury, property damage, and even death. I wish to participate in the Activities knowing they are dangerous and could result in death, injury, or property damage. I accept and assume all of the risks of all injuries, including death, to me or my property, including without limitation, my horse, dogs, other animals of mine, or any of my equipment.

In exchange for being permitted to engage in the Activities, or to be upon the Released Parties’ real property for any reason, I, for myself, my heirs, guardians, and legal representatives, release and agree not or make or bring any claim of any

kind against the Released Parties for any injury or death to me, or any damage to my property, arising out of my use of or being on the Released Parties’ real property, or my participation in any of the Activities with or without the Released Parties.

I understand and agree that the terms of this document shall apply whether I am on the real property of the Released Parties or not. Thus, any claim that I think I may have, whether it arose on the Released Parties’ real property or not, is released by this document. The intent of this document is to release all claims, regardless of where they may have arisen or occurred.

To ensure that I do not sign this agreement, then violate it or have it violated for me, I agree that if anyone makes any claims because of any injury to me or death, or for any damage to my property, I hereby indemnify and hold the Released Parties harmless from and against all claims, costs, expense or loss, including, but not limited to, reasonable attorney’s fees and court costs.

To further ensure that I do not sign this agreement, then violate it or have it violated for me, I agree that as a condition precedent to the filing, commencement, or even asserting a claim against the Released Parties which would violate the terms hereof (such as an attorney’s letter, e-mail or telephone call to the Released Parties’ insurance company), I, or my representative, must deposit with the Clerk of the Supreme Court, Dutchess County, New York, the sum of One Hundred Thousand Dollars ($100,000.00) in good funds, for the benefit of the Released Parties, to enable them to recover their costs, expenses or losses, including, but not limited to, reasonable attorney’s fees and court costs, for any violation hereof. In the event that this security is not so deposited prior to the assertion or commencement of any claim, I agree that the Released Parties shall be entitled to dismissal of any claim, with prejudice, with costs, and upon the merits, for non-compliance with this condition precedent, and shall also be entitled to judgment for all claims, costs, expenses or losses, including, but not limited to reasonable attorney’s fees and court costs. I recognize that this could be considered a harsh result, but freely agree to this entire document in order to secure the ability to participate in the Activities, and to ensure that this document can be practically enforced, rather than disregarded or avoided by me or any attorney I or my representative may select. I understand that, but for this agreement, I would never have participated in any of the Activities.

I represent and acknowledge that prior to signing this document I had the opportunity to seek counsel concerning its terms and effect. If I did not seek the advice of counsel, this was only because I chose not to.

I further represent that I have not been coerced, misled, or forced into signing this

agreement. I have read its terms, understand them, and freely make this agreement.

This agreement shall be binding upon and inure to the benefit of the parties hereto and their respective personal representatives, heirs, successors, and assigns.

This agreement shall be construed and enforced pursuant to the laws of the State of New York. Any question concerning this agreement’s interpretation or enforcement shall be determined in the Supreme Court, Dutchess County, New York. If any provision herein is determined by a Court of competent jurisdiction to be invalid, the remaining provisions shall remain effective.
