Please read this agreement carefully before registering for or attending the event. By registering for, attending, or voluntarily participating in the Afrobeat Jollof & Jerk Festival & Community Resource Fair ("Event"), you acknowledge and agree to the following terms to the fullest extent permitted by California law.


1. Voluntary Participation and Assumption of Risk

I understand that my attendance and participation in the Event are voluntary.

I understand that a public outdoor festival may involve ordinary and inherent risks, including, but not limited to:

  • Slips, trips, falls, or other injuries;
  • Outdoor weather and environmental conditions;
  • Crowds and interactions with other attendees;
  • Food preparation, consumption, food allergies, foodborne illness, or adverse reactions;
  • Participation in games, children's activities, demonstrations, entertainment, or other festival activities;
  • Contact with equipment, temporary structures, tables, tents, or other event materials;
  • Acts or omissions of independent vendors, exhibitors, contractors, performers, or other third parties; and
  • Other risks reasonably associated with attending a public community festival.

I knowingly and voluntarily assume the ordinary and inherent risks associated with my attendance and participation in the Event.

I am responsible for determining whether I and any minor child attending under my supervision are able to participate safely in any activity.


2. Food and Allergy Notice

I understand that food and beverages served or sold at the Event may be prepared by independent restaurants, caterers, food vendors, or other third parties.

Foods may contain or come into contact with common allergens, including but not limited to peanuts, tree nuts, dairy, eggs, wheat, soy, fish, shellfish, sesame, and other ingredients.

Individuals with food allergies, dietary restrictions, or medical concerns are responsible for asking the applicable food provider about ingredients and preparation methods before consuming any food or beverage.

Kedu Africa TV cannot guarantee that any food or preparation area will be free from allergens or cross-contact.


3. Release and Waiver of Liability

To the fullest extent permitted by California law, I release and discharge Kedu Africa TV and its directors, officers, employees, volunteers, agents, representatives, event organizers, and affiliated event personnel ("Released Parties") from claims for personal injury, property damage, or other loss arising from the ordinary negligence of the Released Parties in connection with my voluntary attendance at or participation in the Event.

This release is intended to apply only to the extent permitted by California law.

Nothing in this agreement is intended to release, waive, or limit liability that cannot lawfully be released or waived, including liability for gross negligence, reckless or willful misconduct, fraud, or other conduct for which liability cannot be waived under applicable California law.


4. Independent Vendors, Exhibitors and Service Providers

I understand that restaurants, food vendors, merchants, nonprofit organizations, government agencies, exhibitors, performers, contractors, and other organizations participating in the Event may operate independently from Kedu Africa TV.

Unless expressly stated otherwise, participation by an organization in the Event does not mean that Kedu Africa TV endorses, guarantees, supervises, or controls the organization's products, professional services, advice, food preparation, or activities.


5. Personal Property

I understand that I am responsible for my personal belongings while attending the Event.

To the fullest extent permitted by law, Kedu Africa TV is not responsible for personal property that is lost, stolen, misplaced, or damaged during the Event except to the extent liability cannot lawfully be waived.


6. Children and Parental/Guardian Responsibility

The Event is family-friendly and children are welcome.

Parents and legal guardians remain responsible for supervising children in their care at all times.

If I bring a minor child to the Event, I acknowledge the ordinary and inherent risks associated with the Event and consent to the child's participation in age-appropriate festival activities.

I understand that this provision does not waive any rights of a minor that cannot legally be waived under California law.


7. Photo, Video and Media Notice and Consent

I understand that Kedu Africa TV and its authorized photographers, videographers, media representatives, and event partners may photograph, record, livestream, or otherwise document the Event.

By voluntarily entering areas in which event photography or recording is taking place, I authorize Kedu Africa TV to use photographs, video recordings, audio recordings, or other images in which I may appear for legitimate nonprofit purposes, including event promotion, educational materials, social media, websites, community outreach, fundraising, news coverage, and promotion of future Kedu Africa TV programs and events, without compensation to me.

I understand that photographs or recordings may be edited, reproduced, published, displayed, or distributed in print or digital media.

For identifiable photographs or recordings focused specifically on a minor, Kedu Africa TV should obtain permission from the minor's parent or legal guardian when required by applicable law or organizational policy.

Attendees who do not wish to be intentionally photographed or featured in promotional content are encouraged to notify event staff upon arrival so reasonable efforts can be made to accommodate the request.


8. Emergency Assistance

If an emergency occurs during the Event, I authorize event personnel to contact emergency medical services when reasonably necessary.

I understand that Kedu Africa TV does not guarantee the availability or outcome of medical treatment and that I remain responsible for medical expenses incurred on my behalf or on behalf of a minor in my care, except where otherwise required by law.


9. Indemnification

To the fullest extent permitted by California law, I agree to indemnify and hold harmless the Released Parties from third-party claims, liabilities, losses, or reasonable costs arising directly from my own negligent or wrongful acts during the Event.

This provision is not intended to require me to indemnify any Released Party for that party's gross negligence, willful misconduct, fraud, violation of law, or other liability that cannot legally be shifted or waived.


10. Compliance With Event Rules

I agree to follow reasonable Event rules, safety instructions, park requirements, and directions from authorized Event personnel.

Kedu Africa TV reserves the right to ask an individual to leave the Event for conduct that threatens the safety of others, substantially disrupts the Event, damages property, or violates applicable law or venue requirements.


11. California Law and Severability

This agreement will be interpreted under the laws of the State of California.

It is intended to be as broad and inclusive as permitted by California law. If any provision is determined to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.


12. Acknowledgment and Electronic Acceptance

By completing registration and selecting the acknowledgment checkbox, I confirm that:

  • I have read and understand this agreement;
  • I understand that participation in and attendance at the Event are voluntary;
  • I understand that this agreement affects certain legal rights;
  • I voluntarily assume the ordinary and inherent risks associated with attending the Event;
  • I agree to the release and other terms stated above to the fullest extent permitted by California law;
  • I am at least 18 years old or am completing registration as the parent or legal guardian responsible for participating minor children; and
  • My electronic acknowledgment is intended to constitute my acceptance of these terms.

By checking the box below and completing my registration, I acknowledge that I have read, understand, and voluntarily agree to the Release of Liability, Waiver of Claims, Assumption of Risk, Indemnity Agreement, and Photo/Media Release for the Afrobeat Jollof & Jerk Festival & Community Resource Fair.

I understand that this agreement includes a release of certain legal claims and an assumption of certain risks. I understand that no provision is intended to waive rights or liabilities that cannot legally be waived under California law.

For registrations that include minor children, I confirm that I am the parent or legal guardian, or otherwise have legal authority to register the minor(s), and I consent to their participation subject to the terms above to the extent permitted by California law.
