CONSENT and RELEASE

In connection with, and as a condition of, the undersigned’s attendance at events conducted by BPM, Trevor Fong and their affiliates (“ORGANIZER”). I confirm, acknowledge and agree as follows:

RELEASE AND LIABILITY WAIVER

In consideration of and as part of my payment for the right to participate in ORGANIZERS Event, the undersigned, my heirs, executors, administrators, successors and assigns do hereby RELEASE, WAIVE, ACQUIT, DISCHARGE, INDEMNIFY, DEFEND, HOLD HARMLESS AND FOREVER DISCHARGE ORGANIZERS, and its owners, subsidiaries, principals, directors, employees, agents, heirs, executors, administrators, successors, and assigns and any of the training instructors, guides, staff or students taking part in the training in any way as well as the venue where the Events are being held and any of its owners, executives, agents, or staff OF AND FROM ALL ACTIONS, CAUSES OF ACTION, CONTRACTS, CLAIMS, SUITS, COSTS, DEMANDS AND DAMAGES OF WHATEVER NATURE OR KIND IN LAW OR IN EQUITY arising from my participation in the Event.

I do hereby acknowledge that the activities at the EVENT may pose known and unanticipated substantial risks of physical injury, psychological or mental injury and/or death, disease or illness and/or damage to or loss of personal property. I hereby knowingly and voluntarily assume any and all risks and do agree and acknowledge that my participation in the EVENTS and any of the EVENTS or programs associated with the Event is of MY OWN FREE WILL AND COMPLETELY VOLUNTARY, regardless of anything stated or implied.

I am fully responsible for any and all decisions I make in conjunction with the Event and I alone will determine which activities I will participate in. I further understand that I DO NOT HAVE TO PARTICIPATE IN ANY ACTIVITY AND I MAY WITHDRAW MYSELF FROM PARTICIPATION AT ANY TIME. I agree I will use my own free will and discretion, considering my physical and mental health, when deciding if it is appropriate for me to participate in any activity.

I also acknowledge that (i) I have read this document, (ii) I will inspect the facilities, grounds and equipment prior to being involved in any activity, (iii) I will not participate until I have conducted such inspection and (iv) my participation is my acceptance of the facility, grounds and equipment (hereinafter (“Sites) as being safe and reasonably suited for the purposes intended and (v) I voluntarily sign this document.

I indicate by my signature below that I have had sufficient opportunity to read this entire release and waiver document and acknowledge that I have understood it, and agree to be bound by its terms. No representations, statements or inducements, oral or written, apart from the foregoing written statement, have been made.

PHOTOGRAPH / TESTIMONIAL CONSENT AND RELEASE

PARTICIPANT, of legal age, hereby grant, irrevocably and perpetually to BPM, Trevor Fong and their subsidiaries, affiliates, successors and assigns thereof, the following:

The right to photograph, video and record my name, voice, appearance, likeness, and/or written testimony along with any material furnished by PARTICIPANT, in whole or in part, in any program provided by BPM, or any affiliate, subsidiary or assign of BPM.

The right to publish, exhibit and distribute the use of my name, voice, appearance, testimonial and/or likeness along with any material furnished by me, in whole or in part, worldwide, for any commercial purpose, including but not limited to the advertising or solicitation of business, by any means of mass and/or electronic media, including but not limited to print, radio, television and promotional materials, events and/or marketing plans.

I hereby release and agree to indemnify and hold harmless BPM and their subsidiaries, affiliates, successors, assigns, officers, directors, agents, owners, employees, thereof, from any and all claims, actions, causes of action, damages, expenses, court costs, attorney fees, liability damage or judgment brought forth as a result of my participation or testimonial materials furnished by PARTICIPANT.

HOLD HARMLESS.

All PARTICIPANTS shall fully defend, indemnify, and hold harmless BPM and VENUE from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury, emotional distress, and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of PARTICIPANTS, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgements, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements to BPM and VENUE for all legal fees, expenses, and costs incurred by it.

ASSUMPTION of the RISK and WAIVER of LIABILITY RELATING to CORONAVIRUS/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization (WHO). COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. By entering the VENUE and/or the EVENT, you:

(a) acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 and that such exposure or infection may result in personal injury, illness, permanent disability, and death,

(b) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expenses, of any kind ("Claims"), that you may experience or incur, and,

(c) hereby release, covenant not to sue, discharge, and hold harmless the venue, EVENT ORGANIZERS, VENUES, and each of their respective parents, members, partners, affiliates, divisions, subsidiaries, and landlords and their respective officers, directors, and employees from claims of any kind arising out of or relating thereto.
