ASSUMPTION OF THE RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT

This Assumption of the Risk, Waiver, and Release of Liability Agreement (“Agreement)” is entered into as of the date of event registered for by the undersigned (“Releasor”). Releasor desires to enter the premises indicated on the event registration and participate in the event (the “Event”). White Coat Mingle, LLC (“WCM”) is willing to allow the Releasor to enter and participate in the Event on the condition that Releasor agrees with this Agreement but that otherwise WCM would not allow such entry or participation in the Event. Therefore, in consideration of WCM allowing Releasor to enter the premises and participate in the Event, Releasor acknowledges, agrees, assumes, waives and relates as follows:

I am aware that my choice to participate in the Event, which includes, but is not limited to, the consumption of alcohol by myself or others, interactions with third parties, as well as indoor and outdoor spaces and facilities may put me at risk for accidents, property damage or other harm during and incidental to the Event. Releasor acknowledges that Releasor’s safety depends upon Releasor’s awareness of him/herself/themself, his/her/their surroundings, as well as how Releasor conducts himself or herself or themself and how Releasor interacts with others. Releasor understands that WCM is not responsible for Releasor’s actions or inactions or the actions or inactions of any third party, including, but not limited to, other participants and guests at the Event. As further set forth below, Releasor releases the Released Parties (as defined below) from all liability related to the participation in the Event.

Communicable Diseases: There is an inherent risk of exposure to communicable diseases, including without limitation COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Releasor is aware of the significant risks associated with Releasor’s physical presence at the Premises and participation in the Event, including the risk of being exposed to or becoming infected with COVID-19 or transmitting COVID-19 to another. Releasor acknowledges that being exposed to, becoming infected with, or transmitting COVID-19 can cause a variety of symptoms and illnesses, including those that may lead to life threatening and life changing conditions or death, and that being at the Premises and participating in the Event carries with it certain risks that cannot be eliminated regardless of the care taken to avoid transmission and illness. Releasor acknowledges that WCM cannot prevent Releasor or anyone else from becoming exposed to, contracting, or spreading COVID-19 while participating in the Event. By participating in the Event, Releasor voluntarily assumes all risks related to exposure to Communicable Diseases including COVID-19.

Releasor hereby further agrees that Releasor is fully and personally responsible for Releasor’s own safety and actions while participating in the Event. With full knowledge of the risks involved, Releasor hereby releases, waives, and discharges WCM, its affiliates, directors, members, managers, agents, employees, volunteers, representatives, successors, and assigns (the “Released Parties”) from any and all liabilities, damages, claims, demands, expenses, costs, losses, injuries, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, illness, or death that may be sustained by Releasor arising from or relating to any participation in the Event, to the fullest extent permissible by law. Releasor agrees to indemnify, defend, protect, and hold harmless WCM from and against any and all liabilities, damages, claims, demands, expenses, costs, losses, injuries, actions, and causes of action arising from or relating to, whether directly or indirectly, any act or omission of Releasor, Releasor’s guests, or Releasor’s participation in the Event.

If any term or provision of this Agreement is invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement, which shall remain fully enforceable. This Agreement is binding on Releasor and Releasors heirs, successors, and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of California. Any claim or cause of action arising out of or relating to this Agreement may be brought only in the federal and state courts located in California and the County of Orange.

I ACKNOWLEDGE THAT I HAVE READ THIS ASSUMPTION OF THE RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO THIS ASSUMPTION OF THE RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT, AND AGREE FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. BY SIGNING BELOW AND/OR PARTICIPATING IN THE EVENT, I HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

PHOTOGRAPH/VIDEO RECORDING RELEASE FORM

I hereby grant White Coat Mingle, LLC (“WCM”) the irrevocable right and permission to use photographs and/or video recordings of me during the Event in publications, promotional flyers, derivative works, or for any other similar purpose without compensation.

I understand and agree that such photographs and/or video recordings of me may be placed on the internet (e.g., social media). I also understand and agree that I may be identified by name and/or title that might accompany the photographs and/or video recordings. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the WCM.

I hereby release, acquit and forever discharge WCM, its affiliates, directors, members, managers, agents, employees, volunteers, representatives, successors, and assigns (the “Released Parties”) from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name or, if I am less than eighteen years old, that my parent or guardian has signed this release form below. This release is binding on me and my heirs, assigns and personal representatives.
