The University of New South Wales Law Journal is pleased to announce the launch of Issue 47(4) on 11 December 2024, where the Hon Justice Julie Ward will deliver a keynote address on the Issue’s Thematic topic: ‘Equity, Conscience and Commercial Morality’. Justice Ward is the President of the New South Wales Court of Appeal and a former Chief Judge in Equity of the Supreme Court. Her Honour was a partner at Mallesons at the time of her appointment to the Supreme Court and was the first female solicitor in NSW to be appointed directly to the bench. Her Honour has presided over numerous cases during her time on the bench, including some of the most complex and contested pieces of commercial litigation in NSW, and many of her judgments have been considered seminal in the development of equitable jurisprudence.
Issue 47(4)’s Thematic component contains seven articles, each providing a detailed examination of the development of equitable jurisprudence in Australia and the use of law to enforce moral standards in commercial dealings. The articles within the Thematic component compose a panorama of legal ideas, including: the development of a new form of ‘alter ego’ liability in equitable claims against third party corporate defendants; the relationship between the Baumgartner joint endeavour principle and the minimum equity rule; the equitable basis for the disqualification of lawyers from acting against former clients; the application of proportionate liability schemes to breaches of trust involving co-trustees; how courts have distinguished between morally questionable and legally unconscionable commercial conduct; the development of a new financial incentives program for corporate whistleblowers in Australia; and the social harms arising from the enslavement of corporations to their shareholders and the manner in which corporations might be freed.
Issue 47(4) also contains three general articles which explore developments in areas beyond equity and commercial law, including: the case for federal social cooperative legislation in Australia as a means of providing more just working conditions for persons with disabilities; the experiences of parents and legal practitioners with alternative dispute resolution as a method of resolving disability discrimination complaints against schools; and the application of the rules of precedent to litigation within the ambit of the UN Sales Convention.
The launch event for Issue 47(4) will take place at 6pm on Wednesday 11 December 2024 at the Sydney office of King & Wood Mallesons.
