WAIVER AND RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK FOR THE UNDERLINE PROGRAMS/ACTIVITIES PLEASE READ THIS FORM CAREFULLY and be aware that in signing up and participating in The Underline's program/activities, you will be expressly assuming the risk and legal liability of, and waiving and releasing all claims for, injuries, damages, or loss which you (or your minor child/ward) might sustain as a result of participating in any and all activities connected or associated with The Underline's programs/activities (including transportation services/vehicle operation, when provided) (the "Activities"). *ASSUMPTION OF RISK; RELEASE AND WAIVER OF LIABILITY. I recognize and acknowledge that there may be certain risks involved in participating in the Activities, and I voluntarily agree to assume the full risk of any injuries, damages, or loss that I (or my minor child/ward) may sustain as a result of said participation. I further agree to waive and relinquish all claims against Friends of the Underline, Inc. and The Underline Conservancy, Inc. (together "The Underline") as well as Miami-Dade County (the "County"), including their respective officials, officers, employees, and volunteers (hereinafter collectively referred to as the "Parties") that I (or my minor child/ward) may have or which may accrue to me (or my minor child/ward) as a result of participating in such programs/activities. I do hereby fully release and forever discharge the Parties from any and all claims for injuries, damages, or loss that I (or my minor child/ward) may have or which may accrue to me (or my minor child/ward), arising out of, connected with, or in any way associated with these programs/activities. *INDEMNIFICATION. I indemnify and hold harmless The Underline; any of its employees, directors, officers, agents; and the County (the "Released Parties") from any and all claims arising out of, connected with, or in any way associated with my use of park property or participation in any park programs or Activities. I will further indemnify and "hold harmless" The Underline; its employees, directors, officers, agents; and the County from all costs, expenses, and liabilities resulting from any claim brought from my (or my minor child's/ward's) use of park property and/or participation in park programs or Activities, to the extent of the park's liability under general law. *MEDICAL TREATMENT. I hereby give consent and authority to The Underline and the County to obtain medical treatment on my behalf (or my minor child/ward) if I (or my minor child/ward) am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I hereby release, forever discharge, and hold harmless The Underline and the County from any claim whatsoever in connection with such treatment or other medical services. *COMMUNICATIONS. I provide The Underline permission to provide email and phone updates to stay informed about upcoming community programs and services. The Underline does not sell, trade, rent, or share personal information to or with any third parties. *PHOTOGRAPHIC RELEASE. I hereby grant The Underline, its representatives, and its employees permission for myself for my minor child/ward), and my property, to be photographed or recorded in connection with the program, activity, or event I willfully choose to participate in. I authorize The Underline, its assignees, and its transferees to copyright, use, and publish the same in print and/or electronically, with or without the use of my name. I understand that any photographs or other types of media production may be used for purposes including, but not limited to, publicity, illustration, advertising, and Web content. **I HAVE READ AND FULLY UNDERSTAND THE ABOVE IMPORTANT INFORMATION, WARNING OF RISK, ASSUMPTION OF RISK, AND WAIVER RELEASE OF ALL CLAIMS**
