Face mask requirements in community settings are only considered lawful because they have been granted Emergency Use Authorization from the Food and Drug Administration in response to Covid. Emergency Use Approved products are only intended for temporary use, to deal with the crisis, because they have not been evaluated for safety or effectiveness.
Now that the Federal emergency is ending on May 11th, many believe the emergency use authorization should end, as well. However, that is not likely. According to the U.S. Department of Health and Human Services, the Food and Drug Administration’s Emergency Use Approval for “COVID-19 products (including tests, vaccines, and treatments) will not be affected” by the ending of the Federal Emergency.
Mask requirements are not going away on their own. However, there are protections in place for who are people expected to wear masks, and very good reasons for them. In the rush to implement mask policies, the harms of masks and the need for protections has been ignored at all levels. Now that the urgency is over, it is time to consider them at last.
