Accident Waiver and Release of Liability

I certify that I am healthy and fully aware for participation in this event and have not been advised otherwise by a qualified medical person.

I acknowledge that this Accident Waiver and Release of Liability (AWRL) form will be used by The Chopping Block, sponsors and/or all other persons associated with this event in which I may participate and it will govern my actions and responsibilities at The Chopping Block.

In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) Waive, release, and discharge from any and all liability for my death, disability personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: The Chopping Block, sponsors and/or all persons associated with this event, and their directors, officers, employees, volunteers, representatives and agents, the event sponsors and event volunteers, (B) indemnify and hold harmless all entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of my actions during this event.

I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during this event and acknowledge understanding that I am responsible for any charges or financial obligations arising from such treatment.

I understand that at this event or related activities I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and/or assigns.

This AWRL shall be construed broadly to provide a release and waiver to the maximum extent permissible under the applicable law.

Food preparation carries with it inherent risks that include but are not limited to health hazards resulting from improper transport, handling and storage. WAIVER: In consideration of being permitted to participate in any chef demonstration or related event at The Media Block (an “Event”) where prepared food, cooked, perishable or otherwise are transported, further prepared, and consumed, I, for myself, my heirs, personal representatives or assigns, agents, employees and affiliates, do hereby release, waive, discharge, and covenant not to sue The Media Block, The French Fry House, City & Harris County, their affiliates, direct or indirect, officers, employees, and agents from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in any Event. ASSUMPTION OF RISKS Participation in any Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary, and can include but are not limited to cooking food thoroughly; separating and not cross contaminating foods; chilling or refrigerating food appropriately; cleaning foodstuffs, instruments and hands used in and for food preparation; fire or gas hazards. INDEMNIFICATION AND HOLD HARMLESS I agree to INDEMNIFY AND HOLD HARMLESS The Media Block, The French Fry House, City & Harris County, their affiliates, direct or indirect, officers, employees, and agents (the “Indemnitees”) from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in Events, whether brought by me, my company or its agents or employees, or other third parties, and to reimburse the Indemnitees for any such expenses incurred. ACKNOWLEDGEMENT OF UNDERSTANDING I have read this Waiver of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, am over the age of 18, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

I acknowledge that this performance event is open to the public and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to: bodily injury arising from physical activities associated with the event and the actions of other people including, but not limited to, participants, volunteers, spectators, performers, event staff, event monitors and/or producers of the event; possible dehydration, weather, and/or other natural conditions. I hereby assume all risks associated with participation in this event.
