What your rights and responsibilities are as a company during a DOL Wage & Hour Investigation
- We will explain and teach the standard process typically followed by investigators so that you are not completely surprised when you receive the notice of investigation. Additionally, you have rights too! It is important to understand those rights to best protect your company.
Which Federal labor laws are covered during Wage & Hour investigations
- For government contractors, not only does an investigator look for Fair Labor Standards Act (FLSA) overtime violations, but also, for Service Contract Act (SCA) and Davis Bacon Act (DBA) prevailing wage and Contract Work Hours and Safety Standards Act (CWHSSA) violations.
What records a company is required to produce if requested
- We will uncover the types of recordkeeping information and documentation that your company will be required to produce to support your classification of employees (i.e., exempt versus non-exempt), wage & fringe benefit compensation/tracking, payroll deductions, hours worked, and the minimum and maximum covered period.
What happens when there is a back wage finding by the investigator
- If the company is in agreement with the findings, you will learn when payment must be made to the employees and the process for providing proof of payment.
- If the company disagrees with the findings, you will learn the process for contesting.
