Understanding the Role of the Circuit Court

The Circuit Court is Virginia's trial court of general jurisdiction, handling a broad spectrum of cases, including civil disputes, criminal cases, and family matters. In Fairfax County, the Circuit Court is the largest in the state, composed of fifteen full-time judges. It has the authority to try a full range of cases, both civil and criminal, jury and non-jury. Civil cases include a wide variety of business disputes, personal injury, and domestic relations cases. The Court hears felony criminal cases.


Supporting Small Businesses and the Community

The Circuit Courts play a pivotal role in fostering a thriving business environment. In Loudoun County, the Clerk of the Circuit Court is an integral part of the Business Assistance Team, offering services such as access to land records. This is crucial for businesses purchasing property, as it provides information on easements and other property details.

Additionally, the Loudoun Small Business Development Center offers a variety of programming to help businesses, including a "Start Your Business in Loudoun" workshop. This collaboration ensures that businesses receive comprehensive support, from legal documentation to practical guidance on starting and growing a business.


Enhancing Court Systems through Collaboration

Both Fairfax and Loudoun County Circuit Courts are committed to improving accessibility and efficiency through innovative collaborations. Under the leadership of Clerk Chris Falcon, the Fairfax Circuit Court has launched initiatives such as eCaseSearch, a free online case information system developed in-house. This platform enhances transparency and allows residents and businesses to access case information conveniently.

In Loudoun County, Clerk Gary Clemens has been instrumental in implementing business-friendly initiatives. The establishment of the Business Assistance Team (BAT) exemplifies this effort. BAT is a cross-departmental group designed to provide a seamless experience for business customers, guiding them through the county's permitting and development processes.

Functions of the Circuit Court Clerk and Benefits to Businesses

The Clerk of the Circuit Court performs numerous functions that are vital to both the legal system and the business community, including:

  • Land Records Management: Maintaining and providing access to land records, which is essential for property transactions and verifying ownership.
  • Business Name Registration: Processing "doing business as" (DBA) filings, allowing businesses to operate under assumed names legally.
  • Judicial Proceedings Support: Managing court documents and ensuring the smooth operation of court cases, which can involve business litigation.
  • Issuance of Licenses: Providing marriage licenses and notary public commissions, services that, while not exclusively business-related, contribute to the community's legal framework.

By efficiently managing these responsibilities, the Clerk's office ensures that businesses have reliable access to necessary legal documents and records, facilitating smoother operations and legal compliance.
