Join us at noon on Tuesday, September 17, at the Milwaukee Club for a Constitution Day luncheon and panel exploring the past, present, and future of originalism.
It’s been said that originalism has developed in three stages. During the first stage, early originalists like Judge Bork and Raoul Berger looked to the intent of the drafters. Then, in stage two, originalists like Justice Scalia turned their focus to ascertaining the intent of the ratifiers. This became known as original public meaning originalism. Now, some have posited that we have entered a third stage, where originalists focus on text, history, and tradition in an effort to decipher the original understanding of legal texts.
In this Constitution Day panel, hosted by the Milwaukee Lawyers Chapter of the Federalist Society, esteemed originalists will explore what originalism means today and what the future of originalism may hold. Panelists will include Justice Brian Hagedorn of the Wisconsin Supreme Court and former United States Attorney Steven Biskupic. The panel will be moderated by Alex Lemke.
