When Negotiation Fails: Publisher Rights Under the Press Publication Right
Host: Agnieszka Wiercińska-Krużewska, Managing Partner

Info: The introduction of neighbouring rights for press publishers under Article 15 of the DSM Directive was intended to rebalance the relationship between media organisations and digital platforms, yet the Polish experience reveals a persistent gap between legislative intent and commercial reality. This session draws on a live dispute in which a group of publishers - representing majority of the Polish press publisher market by collective management coverage - initiated formal mediation proceedings after months of unsuccessful negotiations with a major digital platform over remuneration for the use of press publications. This presentation examines the legal and strategic mechanisms available when negotiation reaches an impasse, the role of regulatory mediation as an enforcement tool, and what the systemic refusal of a global platform to engage meaningfully with collective rights management signals for the future of media law across jurisdictions.
