In consideration for express or implied acceptance or use of certain special arrangements made by [TREVOR FONG & MADE 4 MORE] to permit, facilitate, expedite or accommodate entry or ability to enter [MIX DOWNTOWN], as well as in consideration for express or implied attendance, presence, participation or joining [MIX & MINGLE MIXER], or because of, due to, or in any way arising out of attendance, presence, participation or joining in the [MIX & MINGLE MIXER], the delivery or receipt of any benefit or value of any kind, nature, extent, amount or degree, whether direct or indirect, tangible or intangible, immediate or future, monetary or not, vested or not or quantifiable or not, and whether delivery or receipt of any such benefit was known or unknown at the time of such delivery or receipt or otherwise at the place and time of the [MIX & MINGLE], whether as express or implied invitee or guest of invitee, or whether as express or implied guest of other guest of invitee, and whether intended or unintended invitee or guest prior to entering [MIX DOWNTOWN], with or without advance knowledge of the [MIXER] prior to entering [MIX DOWNTOWN] (the “Consideration”), I, for and on behalf of myself and my heirs, assigns, agents, representatives, successors, trustees, beneficiaries, executors, administrators, and anyone else who may claim through or for me, or otherwise who may claim on my behalf (collectively, the “Releasing Parties”), hereby release and forever discharge [TREVOR FONG & MADE 4 MORE] and [THEIR] employees, independent contractors, sponsors, underwriters, promoters, advertisers, planners, vendors, performers, volunteers, assistants, partners, affiliates, heirs, assigns, agents, representatives, successors, trustees, beneficiaries, executors, administrators, and anyone else assisting [TREVOR FONG & MADE 4 MORE] with, or on [host’s] behalf, directly or indirectly planning, preparing, promoting, marketing, advertising, presenting, facilitating, arranging, staging, furnishing, actualizing, conducting, hosting or otherwise making the [MIXER] or any part of the [MIXER] open, ready or available for Releasing Parties’ express or implied, intended or unintended, attendance, participation or benefit (collectively, the “Host Parties”), from any and all liabilities, claims, actions, injuries, harm, damages, personal property damage, real property damage, or other losses of any kind, of any nature, and of any extent, amount and degree, that Releasing Parties may have, discover, develop or acquire, whether known or unknown at the time, against Host Parties that in any way arise out of, are connected with, or otherwise relate in any way to my attendance, presence, participation or joining the [MIXER] or Host Parties in or at [MIX DOWNTOWN], regardless of time or location within [MIX DOWNTOWN].

MEDIA CONSENT AND RELEASE

In further exchange for the Consideration, Releasing Parties hereby grant, convey and transfer to [TREVOR FONG & MADE 4 MORE] and [THEIR] companies, parent companies, subsidiaries, partnerships, affiliates, joint ventures, associations, heirs, assigns, agents, representatives, successors, trustees, beneficiaries, executors and administrators, as well as sponsors, underwriters, promoters and advertisers authorized and approved by [TREVOR FONG & MADE 4 MORE] (collectively, the “Host Affiliates”), a royalty- free, fully paid up, absolute and irrevocable, non-exclusive license to use, display, copy, publish, circulate, broadcast, sell and sublicense photographs or sounds of me, my likeness or caricature, whether audible, visual or both, as may be taken, captured, recorded, filmed or memorialized by any of the Host Parties in any way and by or through whatever medium, mechanism or equipment, and whether in native form or as retouched, digitized, cropped, realigned, enhanced, altered, distorted or modified in any way, for [TREVOR FONG & MADE 4 MORE] and Host Affiliates to use, in whatever form or medium, throughout the universe, in perpetuity, in any and all media now known or hereafter devised, for whatever purposes, including, but not limited to, advertising, promoting or publicizing the [MIXER], [TREVOR FONG & MADE 4 MORE] and [THEIR] current or future services, products, events, reputation and goodwill. I further agree that any and all derivative works, of whatever form, medium, and content, created or resulting from rights granted under this license, and any and all monies, returns, credits, and other forms of benefits or income resulting from such derivative works, shall be of the sole title, interest, right, and ownership of [TREVOR FONG & MADE 4 MORE].

INDEMNIFICATION AND HOLD HARMLESS

In further exchange for the Consideration, Releasing Parties hereby agree to indemnify and hold harmless the Host Parties and Host Affiliates from any and all third-party liabilities, claims, actions, injuries, harm, damages, personal property damage, real property damage, or other losses of any kind, of any nature, and of any extent, amount and degree, including, but not limited to, attorneys’ fees and court costs incurred in connection with third-party claims, which in any way arise out of, are connected with, or otherwise relate in any way to my attendance, presence, participation or joining the [MIXER] or Host Parties in or at [MIX DOWNTOWN], regardless of time or location within [MIX DOWNTOWN].

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. By entering the venue and/or the event, you (a) acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 and that such exposure or infection may result in personal injury, illness, permanent disability, and death, (b) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expenses, of any kind (“Claims”), that you may experience or incur, and (c) hereby release, covenant not to sue, discharge, and hold harmless the venue, event promoter(s), vendor(s), and each of their respective parents, members, partners, affiliates, divisions, subsidiaries, and landlords and their respective officers, directors, and employees from claims of any kind arising out of or relating thereto.
