Every marriage must be registered with the local Union Council to avoid legal complications. In cases of divorce, a husband must send a written notice of talaq to the Union Council, which arranges reconciliation meetings before finalizing the divorce after 90 days. Similarly, a wife can seek khula through the Family Court, which may require her to return the dower (haq mehr). The law mandates that husbands provide financial support (nafaqah) to their wives and children, with courts determining the amount based on income and lifestyle.
Child custody decisions prioritize the child’s welfare, with mothers usually retaining custody of young children while fathers are responsible for financial support and visitation rights. Inheritance laws follow Islamic principles, ensuring that daughters, sons, spouses, and parents receive their rightful shares, although daughters inherit half the share of sons. Women have full legal rights to claim their inheritance and can approach the court if denied. Domestic violence victims are protected under the Domestic Violence (Prevention and Protection) Act, allowing them to seek protection orders and justice through Family Courts.
