Maria O’Loan - Carbon Border Adjustment Mechanism (C-BAM) - Implications for the construction sector

CBAM is a tax which will apply to materials commonly used in the construction sector, and will, when the dual regimes of the UK CBAM and EU CBAM become fully operational have major implications for the cost and availability of materials. Contractors will need to consider the implications of this when pricing work and entering contracts. This is part of an increasing regulatory focus on the carbon footprint of the construction industry.

The UK’s Carbon Border Adjustment Mechanism (CBAM), due to be implemented from 2027, is a policy aimed at reducing carbon emissions by imposing tariffs on imported goods that do not meet the UK’s environmental standards. CBAM targets the reduction of embodied carbon emissions – those emissions produced during the manufacturing and transportation of building materials.

When it becomes fully operational in 2026, the EU CBAM will impose charges on the importation of goods in the iron and steel, aluminium, cement, fertilizer, and hydrogen sectors, as well as on imports of electricity —exposing them, for the first time, to the full economic cost of their emissions.

Maria O’Loan will provide an overview of both EU and UK CBAM regimes and identify the risk, opportunities and challenges to the construction sector as well as the steps that should be taken to mitigate any adverse impacts.

Paul Eastwood - Public Procurement Legislation: all change

The regime of legislation which applies to the procurement of goods, works and services by UK public bodies and utilities is due to be replaced later this year; with expected go-live of the new legislation at 28 October.

As purchasers begin to roll-out the new procedures, suppliers will need to know what to expect in terms of the new processes to be followed, what opportunities can be harnessed and what rights can be relied upon to protect their involvement.

Paul Eastwood (Partner, Procurement team) will provide an overview of:

• the structure of the new legislative framework;
• the main changes bidders can anticipate during bid stage; and
• remedies and how challenge proceedings can be brought.

This is intended to be a high-level briefing, with an opportunity for Q&A to conclude.
