This course introduces Agents, Brokers, REALTORS® and non- REALTORS® to the law and settlement agent practice related to these types of title issues. The course will go over basic definitions and examples of the covered topics and will include a discussion of how real estate practitioners can identify issues, advise clients and resolve conflicts.
Course Objectives: Upon completion of this course, students will be able to
(1) understand & properly identify property owner liability related to Trees, Fences and Shared Walls
(2) understand and properly identify several types of encroachments and easements
(3) gain a working knowledge of how settlement agents (closing attorneys, real estate lawyers) determine how to handle encroachments, easements and shared improvements
(4) gain an understanding of how title insurance plays a role in covering property owners when these conditions exist.
