Before the booking amount leaves your account.
What goes wrong when buyers skip this conversation
• A buyer books a Rs 1.4Cr apartment. RERA registration has lapsed. The project is not legally allowed to accept new bookings. The developer does not volunteer this information.
• A buyer signs the agreement. The carpet area in the agreement is 12 percent lower than what the sales executive quoted as 'super built-up'.
• A buyer pays the booking amount on a project that has not secured the occupancy certificate for the previous phase. Phase 3 cannot be legally offered until phase 2 OC is received.
• A buyer pays a booking amount, then discovers the payment plan is 90:10 construction-linked — meaning 90 percent is due before possession. Their cash flow cannot support it.
All four of these are real scenarios from Gurgaon projects in the last 3 years.
The MS Realtors India 12-point pre-booking checklist
• RERA registration: active, not lapsed, not applied-for — confirmed at rera.haryana.gov.in in your session
• Carpet area: the registered carpet area per RERA — not the super built-up, not the developer's 'usable area'
• Developer financial health: outstanding debt, escrow compliance, unsold inventory in previous projects
• Delivery track record: last 3 comparable projects — actual possession date vs promised possession date
• Payment plan: all stages, all amounts, all due dates — in writing before the booking amount
• GST applicability: under-construction attracts 5 percent GST. Ready-to-move resale does not.
• OC and CC status: occupancy certificate and completion certificate status for all preceding phases
• Maintenance charges: pre-possession and post-possession amounts — some developers charge both
• PLC charges: preferential location charges for floor, facing, and corner — declared upfront or hidden until allotment
• Car parking: surface, covered, or mechanical? Included in price or charged separately?
• Resale and subletting clause: does the agreement restrict your right to sell during construction?
• Builder-buyer agreement: is it the standard HRERA-prescribed format or a developer-modified version?
