During this time:
The T visa policy manual explains that conspiracy and attempt to commit labor or sex trafficking can result in T visa eligibility for the victim. Lawyers often get hung up on how attempt or conspiracy even works or what it is. There is no requirement regarding the length of time the labor or services are performed or the means used to induce the acts of labor or sex trafficking, according to the T visa policy manual issued in 2021. Nevertheless, the applicant must establish that the trafficker acted for the purpose of subjecting the victim to involuntary servitude, peonage, debt bondage, slavery, or a commercial sex act. The duration of the labor or services may be relevant in assessing the trafficker’s purpose or motivation. Let’s go back to basics and learn about what conspiracy and attempt is, from a former assistant district attorney who has prosecuted cases. Join Rosetta Royster to learn about these concepts of conspiracy:
- Definitions of conspiracy (federal and state examples)
- The Wheel and Spokes Approach
- The Chain Approach
o How chain approach may work for showing a person is in the US on account of that chain
- What is complicity?
- Why this is important for T visa lawyers? (hint : the more you know these topics, the easier your T screening and statement development will be)
